2. HEALTH, FITNESS AND MEDICAL DISCLAIMER

Axiom Healing provides health, fitness, movement, recovery, coaching and educational services.

Unless explicitly stated otherwise, Axiom Healing services are not medical diagnosis or medical treatment and are not a substitute for care from a physician or other appropriately licensed healthcare professional.

Information provided through our website, coaching, programs, videos, guides, workshops or digital resources is intended for educational and general health or performance purposes.

You should seek appropriate medical advice where necessary, particularly if you:

  • have a medical condition;
  • have experienced a significant injury;
  • are pregnant or postpartum;
  • experience unexplained or severe pain;
  • experience dizziness, fainting, neurological symptoms, chest pain or breathing difficulty;
  • have cardiovascular or metabolic disease;
  • have undergone recent surgery;
  • have a connective-tissue disorder or significant joint instability;
  • take medication that may affect exercise tolerance; or
  • have otherwise been advised to seek professional medical supervision.

You are responsible for communicating relevant health information before participating in Axiom Healing services.

3. EXERCISE AND MOVEMENT RISK

Physical activity involves inherent risks.

These may include soreness, fatigue, falls, strains, sprains, aggravation of existing conditions and other injuries.

Exercise and movement should always be performed within your individual capabilities.

You agree to:

  • follow instructions provided;
  • use appropriate judgment;
  • stop an exercise if you experience unusual or concerning symptoms;
  • avoid performing movements that you believe are unsafe for you; and
  • obtain medical clearance where appropriate.

Participation in any exercise or movement program is voluntary.

To the fullest extent permitted by law, you accept the ordinary and inherent risks associated with physical activity.

Nothing in these Terms removes any rights or protections that cannot legally be waived.

4. HYPERMOBILITY AND INDIVIDUAL VARIABILITY

Axiom Healing provides education and coaching that may be particularly relevant to individuals with joint hypermobility.

Hypermobility exists on a spectrum, and individuals may have substantially different medical histories, diagnoses, symptoms, joint stability, pain presentations and exercise tolerances.

Participation in an Axiom program does not constitute diagnosis of:

  • hypermobility spectrum disorder;
  • Ehlers-Danlos syndrome;
  • connective-tissue disease; or
  • any other medical condition.

Clients with diagnosed or suspected connective-tissue disorders should involve their healthcare team where appropriate.

5. INDIVIDUAL RESULTS

Individual results vary.

Axiom Healing does not guarantee:

  • elimination of pain;
  • injury recovery;
  • increased strength;
  • weight loss;
  • increased mobility;
  • improved athletic performance;
  • specific health outcomes; or
  • any particular financial, professional or personal result.

Results depend on numerous factors including consistency, health status, lifestyle, adherence, training history, injury history and individual physiology.

Testimonials and examples represent individual experiences and should not be interpreted as guaranteed outcomes.

6. PERSONAL TRAINING AND COACHING PACKAGES

Training and coaching packages may be purchased in advance based on an agreed number of sessions.

Prepayment reserves coaching services and, where applicable, recurring appointment availability.

Monthly packages are intended for clients who want consistent access to recurring coaching appointments.

Purchasing a package does not guarantee alternative appointment times outside the client's regularly scheduled appointment.

7. AXIOM-CANCELLED SESSIONS

If Axiom Healing cancels or reschedules an appointment, the client does not lose that session.

The session remains fully credited.

Axiom Healing will make reasonable efforts to reschedule the session at a mutually convenient time.

The replacement session may occur:

  • later during the same week;
  • later during the same month; or
  • during the permitted rollover period.

A session cancelled by Axiom Healing will not be treated as completed or forfeited.

8. CLIENT CANCELLATIONS

Clients should provide at least 24 hours' notice when cancelling or requesting to reschedule an appointment.

With sufficient notice, Axiom Healing will make reasonable efforts to provide an alternative appointment, subject to availability.

Appointments cancelled with less than 24 hours' notice may be treated as completed sessions.

Missed appointments or no-shows may also be treated as completed sessions.

Exceptions may be made at Axiom Healing's discretion for genuine emergencies, illness or other exceptional circumstances.

9. PLANNED TRAVEL AND ABSENCES

Clients should provide as much advance notice as reasonably possible regarding:

  • vacations;
  • work travel;
  • family commitments;
  • medical appointments; or
  • other planned absences.

Where sufficient notice is provided, Axiom Healing will make reasonable efforts to accommodate scheduling changes.

Alternative appointment times cannot be guaranteed.

10. SESSION ROLLOVER

Training packages are intended to be completed during the service period for which they were purchased.

Where circumstances reasonably prevent completion, Axiom Healing may permit up to one eligible unused session to carry forward for up to 30 days.

Unused sessions do not accumulate indefinitely unless Axiom Healing agrees otherwise in writing.

Sessions remaining after the applicable rollover period may expire.

Any discretionary accommodation made in one situation does not create an obligation to provide the same accommodation in future situations.

11. AD-HOC TRAINING

Where available, clients may choose to purchase individual sessions rather than a recurring monthly package.

Ad-hoc sessions:

  • are subject to availability;
  • do not reserve a recurring weekly appointment;
  • may be booked only from available appointment times; and
  • may be priced differently from recurring coaching packages.

Recurring package clients receive priority for recurring appointment availability.

12. ILLNESS

Clients should notify Axiom Healing as soon as reasonably possible if illness prevents attendance.

Axiom Healing may also cancel or reschedule an appointment if illness or another health or safety concern makes proceeding inappropriate.

Axiom Healing will not knowingly conduct an in-person session while experiencing an illness that could reasonably put clients at risk.

Sessions cancelled by Axiom Healing remain fully credited.

13. LATE ARRIVALS

Clients arriving late may receive a shortened session so that subsequent appointments can begin on time.

The original appointment fee remains payable.

Where Axiom Healing begins a session late, reasonable efforts will be made to provide the full scheduled service.

14. MONTHLY SUBSCRIPTIONS

Certain Axiom Healing programs may be offered through recurring subscriptions.

Examples may include:

  • Axiom Flow;
  • community memberships;
  • digital coaching;
  • exercise programming; and
  • other recurring services.

Where recurring billing applies, the subscription price, billing frequency and applicable taxes will be disclosed before purchase.

By purchasing a recurring subscription, you authorize the applicable payment provider to charge your selected payment method at the stated billing interval until the subscription is cancelled.

15. SUBSCRIPTION CANCELLATION

Subscribers may cancel recurring subscriptions according to the cancellation process provided through the relevant platform or by contacting Axiom Healing.

Cancellation normally stops future billing.

Unless otherwise stated, cancelling a subscription does not automatically create a refund for a billing period that has already begun.

Access may continue until the end of the current paid billing period.

Applicable consumer protection rights remain unaffected.

16. AXIOM FLOW

Axiom Flow is a structured digital movement, strength, mobility, recovery and performance program.

The program may include:

  • daily movement sessions;
  • instructional videos;
  • monthly programming phases;
  • exercise demonstrations;
  • educational material;
  • community access;
  • progressions;
  • live or recorded education; and
  • other features.

Program structure may evolve over time as Axiom Healing updates its methodology and educational content.

Axiom Flow is designed for general education and exercise programming and is not individualized medical treatment.

Users are responsible for selecting appropriate exercise intensity and seeking professional advice when necessary.

17. ONLINE COACHING

Individual online coaching may include services such as:

  • assessment;
  • program design;
  • exercise programming;
  • performance planning;
  • habit coaching;
  • accountability;
  • messaging;
  • video review;
  • progress review; and
  • educational support.

The exact scope of coaching will depend on the service purchased.

Communication response times are not guaranteed to be immediate unless expressly stated in the purchased service.

Online coaching does not provide emergency medical support.

18. THIRD-PARTY PLATFORMS

Axiom Healing may use third-party services to deliver parts of its programs.

These may include platforms such as:

  • Trainerize;
  • payment processors;
  • scheduling software;
  • email service providers;
  • video conferencing platforms;
  • website hosting services;
  • analytics platforms; and
  • other technology providers.

Your use of these services may also be governed by the third party's own terms and privacy policies.

Axiom Healing is not responsible for temporary outages, technical failures or service interruptions caused by third-party platforms outside our reasonable control.

19. ACCOUNTS AND LOGIN INFORMATION

Where an account is required, you are responsible for maintaining the confidentiality of your login information.

You may not:

  • share paid login credentials with others;
  • permit unauthorized users to access subscription content;
  • attempt to circumvent access controls; or
  • create accounts using false information.

Axiom Healing may suspend or terminate accounts where unauthorized access or misuse is reasonably suspected.

20. DIGITAL CONTENT AND INTELLECTUAL PROPERTY

Unless otherwise stated, all Axiom Healing materials remain the intellectual property of Axiom Healing or the applicable rights holder.

This includes:

  • videos;
  • exercise programming;
  • written materials;
  • PDFs;
  • guides;
  • graphics;
  • diagrams;
  • educational frameworks;
  • course materials;
  • presentations;
  • program structures;
  • Axiom Healing Method materials;
  • branding;
  • logos;
  • templates; and
  • other proprietary content.

Purchasing or accessing Axiom content provides you with a limited, personal, non-exclusive and non-transferable right to use that content for its intended purpose.

You may not, without written permission:

  • copy;
  • reproduce;
  • redistribute;
  • sell;
  • license;
  • upload;
  • publicly display;
  • teach;
  • commercially exploit; or
  • materially reproduce Axiom Healing content.

21. FREE MATERIALS

Axiom Healing may provide free resources including:

  • guides;
  • PDFs;
  • videos;
  • workshops;
  • newsletters;
  • assessments; and
  • educational resources.

Free resources are provided for educational purposes.

Access to a free resource does not create a therapist-client, healthcare-provider-patient or other professional relationship unless a separate service relationship has been established.

22. EMAIL COMMUNICATIONS

Where you separately consent to receiving marketing communications, Axiom Healing may send:

  • educational emails;
  • program updates;
  • newsletters;
  • workshop invitations;
  • offers;
  • announcements; and
  • other business communications.

You may unsubscribe from marketing emails using the unsubscribe mechanism provided.

Transactional communications relating to purchases, appointments, subscriptions or account administration may still be sent where necessary.

Axiom Healing will comply with applicable Canadian electronic communications requirements.

23. MASSAGE THERAPY AND MANUAL SERVICES

Massage or manual therapy services are provided according to the practitioner's qualifications, professional standards and applicable requirements.

Clients are responsible for providing accurate health information and identifying:

  • injuries;
  • surgeries;
  • medications;
  • health conditions;
  • allergies;
  • contraindications; and
  • relevant changes in health.

Treatment may be modified, postponed or declined if Axiom Healing determines that proceeding would be inappropriate or unsafe.

24. INSURANCE RECEIPTS

Where applicable, receipts may be issued for eligible professional services.

Axiom Healing does not guarantee that any insurer will reimburse a particular service.

Clients are responsible for confirming their own insurance coverage.

Only eligible services actually delivered by an appropriately qualified practitioner will be identified as such on receipts.

Coaching, digital programs, subscriptions, education or other non-insurable services will not be represented as insured massage therapy services.

25. PRODUCTS

Where Axiom Healing sells physical products, reasonable efforts will be made to describe them accurately.

Product packaging, design, ingredients, availability and pricing may change.

Clients should review ingredients and usage instructions and discontinue use if irritation or an adverse reaction occurs.

Nothing associated with an Axiom Healing consumer product should be interpreted as a medical claim unless specifically authorized under applicable law.

26. PRICES AND TAXES

Prices may change from time to time.

The applicable price will normally be the price disclosed at the time of purchase.

Applicable taxes may be added where required.

Where recurring subscription prices are changed, reasonable notice will be provided where required by law or the applicable payment platform.

27. PAYMENT

Payment may be collected through:

  • electronic transfer;
  • credit card;
  • debit card;
  • online payment processor;
  • recurring subscription billing; or
  • another approved payment method.

Clients are responsible for providing accurate billing information.

Axiom Healing may suspend access to unpaid services where payment is overdue.

28. REFUNDS

Except where required by law, prepaid service packages are generally non-refundable once the applicable service period has begun.

Sessions cancelled by Axiom Healing remain credited and are not considered forfeited.

Digital products that have been accessed, downloaded or delivered may be non-refundable except where required by law.

Subscription payments already processed are generally non-refundable unless otherwise stated.

Exceptional circumstances may be reviewed individually.

Nothing in this section limits rights provided under applicable consumer protection legislation.

29. CHARGEBACKS

Clients should contact Axiom Healing first if they believe a billing error has occurred.

Fraudulent or improper chargebacks may result in:

  • suspension of services;
  • termination of accounts; and
  • recovery of legitimate outstanding amounts where permitted by law.

30. WORKSHOPS AND EVENTS

Workshops, webinars, seminars or educational events may have their own:

  • registration conditions;
  • attendance requirements;
  • cancellation deadlines;
  • refund policies; and
  • participation requirements.

Where event-specific terms are provided, those terms apply in addition to these Terms.

31. PRACTITIONER EDUCATION

Axiom Healing may offer educational programs for health, fitness, massage or performance professionals.

Participation does not grant professional licensure, regulatory recognition or permission to practise outside the participant's lawful professional scope.

Where continuing education credit is offered, the applicable approving organization, number of credits and eligibility requirements will be identified separately.

Participants remain responsible for confirming whether a course qualifies for their own professional requirements.

32. MINORS

Services for individuals under the age of majority may require consent from a parent or legal guardian.

Axiom Healing may require the parent or guardian to:

  • complete intake documentation;
  • provide consent;
  • remain present; or
  • approve participation.

Requirements may vary based on service type and age.

33. PRIVACY

Personal information is handled in accordance with the Axiom Healing Privacy Policy and applicable privacy requirements.

Please review the Privacy Policy available on the Axiom Healing website.

Health or other sensitive information should only be provided through approved channels.

34. USER CONDUCT

You may not use the website, programs or services to:

  • violate any law;
  • infringe intellectual property rights;
  • harass or threaten another person;
  • distribute malware;
  • attempt unauthorized access;
  • scrape restricted content;
  • misrepresent your identity;
  • interfere with technical systems;
  • reproduce proprietary programs without authorization; or
  • engage in fraudulent activity.

Axiom Healing may restrict or terminate access where these Terms are materially violated.

35. COMMUNITY CONDUCT

Where Axiom Healing provides a digital community, participants are expected to communicate respectfully.

Axiom Healing may remove content or participants where conduct includes:

  • harassment;
  • abuse;
  • discrimination;
  • threats;
  • spam;
  • unauthorized promotion;
  • disclosure of another person's confidential information; or
  • conduct that materially disrupts the community.

Community participation does not create a confidential healthcare relationship between participants.

Members should not post information they do not wish other community participants to see.

36. TESTIMONIALS AND CLIENT CONTENT

Axiom Healing will not use identifiable client testimonials, photographs, videos or case information for marketing without appropriate permission.

Where consent is provided, clients may withdraw future permission subject to any material already lawfully published or distributed.

37. WEBSITE INFORMATION

Axiom Healing makes reasonable efforts to keep website information accurate and current.

However, information may occasionally contain:

  • typographical errors;
  • outdated information;
  • pricing errors;
  • availability errors; or
  • technical inaccuracies.

Axiom Healing may correct such information when identified.

38. THIRD-PARTY LINKS

The website may contain links to third-party websites or services.

Axiom Healing does not control those third parties and is not responsible for:

  • their content;
  • privacy practices;
  • availability;
  • products; or
  • services.

Users should review third-party terms before using those services.

39. AVAILABILITY OF SERVICES

Axiom Healing does not guarantee that the website, apps, digital programs or third-party platforms will always be uninterrupted or error-free.

Temporary interruption may occur because of:

  • maintenance;
  • platform outages;
  • internet disruption;
  • updates;
  • security events; or
  • circumstances outside our control.

Reasonable efforts will be made to restore access where appropriate.

40. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Axiom Healing will not be responsible for indirect, incidental, special or consequential losses arising from use of the website, digital content or services.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

Nothing in these Terms removes statutory consumer rights.

41. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify Axiom Healing against claims, losses or expenses resulting from:

  • your unlawful use of our services;
  • unauthorized reproduction or distribution of our content;
  • material violation of these Terms; or
  • violation of the rights of another person.

This provision does not apply where prohibited by law.

42. TERMINATION OF SERVICES

Axiom Healing may suspend or terminate services or account access where there is:

  • serious misconduct;
  • harassment;
  • threats to safety;
  • fraud;
  • persistent non-payment;
  • unauthorized distribution of content;
  • repeated material violation of these Terms; or
  • another substantial reason making continuation of the relationship unreasonable.

Where appropriate, reasonable notice will be provided.

Rights and obligations that reasonably survive termination remain in effect.

43. FLEXIBILITY AND DISCRETION

Axiom Healing recognizes that illness, family responsibilities, travel and unexpected circumstances occur.

Reasonable flexibility may be provided at Axiom Healing's discretion.

Providing an exception or accommodation in one instance does not permanently modify these Terms or create an entitlement to the same exception in the future.

44. CHANGES TO SERVICES

Axiom Healing may modify:

  • services;
  • programs;
  • schedules;
  • platforms;
  • features;
  • instructors;
  • program content; or
  • pricing.

Material changes affecting an active paid subscription or service will be handled in accordance with applicable law and any specific service agreement.

45. CHANGES TO THESE TERMS

These Terms may be updated periodically.

The current version and effective date will be posted on the Axiom Healing website.

Material changes will apply prospectively where required.

Continued use of the website or services after an updated version takes effect may constitute acceptance of the updated Terms where permitted by law.

46. SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be interpreted or severed to the minimum extent necessary.

The remaining provisions will continue in effect.

47. NO WAIVER

Failure by Axiom Healing to enforce a provision of these Terms on one occasion does not waive the right to enforce that provision later.

48. ENTIRE AGREEMENT

These Terms, together with:

  • the Privacy Policy;
  • applicable informed-consent documentation;
  • intake forms;
  • service-specific agreements;
  • subscription terms;
  • event-specific terms; and
  • other policies expressly incorporated by reference,

constitute the applicable agreement between Axiom Healing and the client or user regarding the relevant service.

Where a signed service-specific agreement directly conflicts with these general Terms, the service-specific agreement will ordinarily govern that particular service to the extent of the conflict.

49. GOVERNING LAW

These Terms are governed by the laws of the Province of Manitoba and the applicable federal laws of Canada.

Any dispute will be subject to the jurisdiction of the courts of Manitoba unless applicable consumer legislation requires otherwise.
